These terms shall apply to the hire of the trailer that we supply to you (Hirer). For the purpose of the following conditions of hire, the person hiring the trailer shall be called the ‘Hirer’. All trailers are wholly owned by Blains Trailers & Tyres Ltd, who shall be called the ‘Owner’. The trailer rented by the ‘Owner’ to the ‘Hirer’ shall be called the ‘Trailer’ which has been identified in these terms.
- Trailer must not be used:
- For any illegal purpose
- By any person without a valid driving licence to tow
- By any person not covered by comprehensive motor insurance
- By any vehicle without a current MOT certificate when applicable
- Outside England, Wales & Scotland
- Hirer expressly acknowledges personal liability to pay Owner on demand
- All fines and court costs for parking or other offences in relation to the trailer by hirer from commencement of this agreement.
- Any costs to repair collision or damages to the trailer. The parts and repairs will be sourced from and carried out by Blains Trailers & Tyres Ltd.
- Hirer must inform the Owner within 48hrs excluding public holidays of any loss, damage occurring to the trailer, any fault which makes the trailer un-roadworthy or liable to cause danger to any person using the trailer or property until such danger or fault has been repaired or corrected. Authorization for expenditure in excess of ten pounds must be obtained from the Owner prior to commencement of the repair
- If the hired trailer is not returned within the agreed contract time we reserve the right to take payment for the extra duration of hire from the credit card information that we hold on record until the trailer is returned. This will be the difference between the agreed fee and the additional daily charge. If the trailer is not returned we reserve the right to take full payment from the credit card details for the full price of a replacement trailer.
- A trailer which is not returned by the end of the agreed hire period will be assumed to be stolen if the Hirer has not advised the Owner of any delay. This will be immediately reported to the police and Hirer’s documents will be passed to the relevant authority to assist with recovery and prosecution.
- The Owner shall not be liable for loss or damage to any goods or property left stored or transported by hirer during the commencement and casement or hire contract
- Hirer shall not sell or offer for sale, assign, or pledge the trailer or any parts, in any manner Inconsistent with the Owner’s ownership.
- The Owner has maintained the trailer to recommended standards and warranted the trailer as roadworthy and suitable for the purpose of renting at the commencement of the rental but the Owner shall not be liable for defects of failures which are not attributed to any breach of this agreement.
- Hirer must take the responsibility for making sure his/her insurance policy covers any damage or loss to themselves during the hire of the trailer
- Hirer shall be responsible for liability arising out of the use of the trailer. The Hirer shall completely indemnify the Owner in respect of all claims by any person for injury to person or property caused by or in connection with, or arising out of the use of the trailer. The Owner shall not be liable for death or any injuries caused to the Hirer or any third parties arising out of the use of the trailer during the hire period.
- It is the responsibility of the Hirer to insure the trailer on a new for old basis.
- The Hirer shall be liable for any legal, court or other costs associated with the recovery of the trailer. The Owner reserves the right to cancel hire in the event of unforeseeable or uncontrollable circumstances such as theft, accident or late delivery of the trailer. In this case the reservation deposit will be returned in full.
- Documents required for hire:
- Full UK photo driving licence
- V5 Log book for vehicle towing
- Insurance Document of Towing Vehicle
- Utility Bill (Gas, Electric, Water) or Council Tax (Within 3 months)
- £240 Deposit must be taken on a Visa card.
- All prices are inclusive of VAT. Weekend Rate is from Friday 4:30pm – Monday 9am. Any late returns will incur an extra days hire charge at ‘Extra Day’ rate for trailer hired
- Hirer will return the trailer when a member of staff is present. Keys not returned will be charged at £30 (Inc. VAT)
Payment
Security deposits can only be taken via credit or debit card. Payment for hire can be made by cash, credit or debit card. We reserve the right to debit the cost of any loss or damage to the trailer whilst on hire.
The hirer is required to pay the rental charge in full prior to the hire.
Trailer Security
Blains Trailers & Tyres will provide every hire trailer with the correct hitchlock. The hirer agrees to employ the most practical and diligent methods of security at all times during the hire period. The hirer is responsible for the cost of any lost items. The Hirer as a condition precedent to liability agrees that any security devices provided by Blains will be fitted when the trailer is not in use.
Vehicle Suitability
The hirer must ensure the tow vehicle is suitable to tow the expected weight. The tow vehicle must be fitted with an EC type approved tow-ar, 50mm ball and a standard 12 volt 7 or 13 pin socket. If the Owner does not deem the Hirers vehicle fit for purpose the Owner may refuse use of the trailer. A refund will be provided in this eventuality.
Trailer Inspection and Return
Before the trailer is released, the Owner and the Hirer will perform a recorded visual inspection. Any marks or damages the Owner is aware will be highlighted. Any damages that are not noted prior to the trailer being accepted will be charged to the Hirer.
A similar inspection shall be carried out upon return of the trailer by the owner and any damage will be recorded and charged for. The Hirer shall return the trailer at the agreed time and location.
The Owner reserves the right to make a surcharge of £30.00 + VAT if the trailer is not clean both externally and internally to a reasonable standard. Any accessories that are loaned with the trailer should be returned in the way in which they were loaned.
Number Plates
It is the responsibility of the hirer to ensure there is a legal number plate on the trailer. The means to fix it onto the trailer can be provided by Blains Trailers & Tyres. If you do not have a number plate and wish to purchase one, the cost is £25 + VAT, however we can not provide one unless the hirer brings their V5 registration document and a full UK driving licence. (Hand written number plates are not classed as a legal number plate)
Required Documents
If the four required documents are not provided on collection the hire will be cancelled and the deposit will not be refunded.
Cancellation Policy
Deposits paid are non-refundable within 48 hours of the scheduled collection date. In the event of you needing to cancel your booking your deposit payment may be lost. To cancel your booking contact us by email at info@blains.co.uk.
